These Terms of Service govern your access to and use of the DearDew website, online store, content, products, customer support channels and related services. By visiting our website, placing an order or using our services, you agree to these Terms of Service.

DearDew is based in Canada and serves customers internationally. Depending on the product, orders are fulfilled by suppliers or fulfilment partners in the United States or China. Our Canadian business address is not a promise that your order ships from Canada. Dispatch location does not establish a product’s country of manufacture.

4. Consumer Rights

Nothing in these Terms of Service excludes, restricts or modifies any consumer protection right, statutory cancellation right, privacy right, warranty, remedy or legal protection you may have under Ontario law, Canadian law or any other law that cannot be excluded, restricted or modified by contract.

5. Eligibility

By using our website, you confirm that you are at least the age of majority in your jurisdiction or that you are using the website with the consent and supervision of a parent or legal guardian. You must not use our website for unlawful, fraudulent or unauthorised purposes.

6. Lawful Use

You agree not to misuse our website or services. You must not:

If customer accounts are available, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. We may suspend, restrict or terminate access to our website, accounts or services if we reasonably believe you have breached these Terms of Service, engaged in fraudulent or unlawful activity, misused our services, or created risk for us, our customers, our service providers or others.

9. Product information

DearDew offers skincare, makeup, hair and body care, and fragrance. Read the product description, quantity, ingredient information, directions and warnings before use. K-beauty inspiration does not mean every product is manufactured in Korea. Screen settings can affect colour appearance, but this does not excuse a product that fails to match its description. Cosmetic information is not medical advice.

10. Errors and Updates

Our website may occasionally contain errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, availability, delivery times or other information. We reserve the right to correct errors, update information, cancel affected orders or refuse orders where permitted by law. If your order is affected, we will contact you where appropriate.

11. Prices, currency and taxes

Prices are in US dollars (USD), unless a different currency is expressly displayed. Shipping charges and taxes collected by DearDew are identified at checkout. Unless expressly included in your checkout total, import duties, import VAT/GST, customs clearance and carrier brokerage charges assessed in the destination country are the buyer’s responsibility and may be payable before delivery. These charges vary by destination, product, shipment value and applicable rules; free shipping does not include them.

This allocation does not remove any obligation imposed by law on DearDew to register for, collect or remit taxes at the point of sale. Amounts already collected at checkout for a particular tax or duty should not be paid twice; contact us with the assessment if you believe a charge is duplicated. Your bank or payment provider may apply its own currency conversion fees.

12. Intellectual Property

All website content, including text, graphics, logos, images, product names, designs, layouts, icons, videos, downloads and other materials, is owned by or licensed to DearDew unless stated otherwise. You may not copy, reproduce, modify, distribute, sell, exploit or use our content for commercial purposes without our prior written consent.

13. Reviews and Submitted Content

If you submit reviews, comments, photos, feedback or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, edit, publish and distribute that content for business, marketing and customer service purposes, subject to applicable law and our Privacy Policy.

You must not submit content that is unlawful, defamatory, misleading, abusive, obscene, discriminatory, infringing, spam-like or harmful. We may moderate, remove or refuse submitted content where we consider it inappropriate or unlawful.

14. Third-party services

Our store uses providers such as Shopify, payment processors, carriers and fulfilment partners. External sites may have their own terms and privacy policies. Our use of providers does not remove DearDew’s obligations as the seller or your mandatory consumer rights.

15. Website Availability

We aim to keep our website available and functioning, but we do not guarantee uninterrupted, secure or error-free access. We may update, suspend, restrict or discontinue parts of the website at any time for maintenance, security, operational or business reasons.

16. Disclaimer

To the maximum extent permitted by law, our website and services are provided on an as-is and as-available basis. We do not guarantee that the website will be free from errors, delays, viruses or uninterrupted access. This disclaimer does not limit any consumer protection rights or other rights that cannot lawfully be excluded.

17. Liability Limits

To the maximum extent permitted by law, DearDew is not liable for indirect, incidental, special, consequential or punitive loss, including loss of profits, loss of revenue, loss of data, loss of goodwill or business interruption arising from your use of the website or services.

Where liability cannot be excluded, our liability is limited to the extent permitted by law. Nothing in these Terms of Service limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited or excluded under applicable law.

18. Responsibility for misuse

You are responsible for unlawful or fraudulent misuse of this website to the extent provided by applicable law. Nothing in these terms requires a consumer to indemnify DearDew for its own wrongdoing or overrides mandatory consumer protections.

19. Governing law

These terms are governed by Ontario law and applicable Canadian law. Ontario courts have non-exclusive jurisdiction. This choice does not deprive consumers of mandatory protections in their country of habitual residence or restrict access to their local courts where applicable law provides that right.

20. Dispute Resolution

If a dispute arises, please contact us first at contact@deardew.com or by phone at +1 (905) 935-4827 so we can try to resolve the matter promptly and fairly. This does not limit your right to contact Consumer Protection Ontario, a regulator, a tribunal or a court where applicable.

21. Changes to these terms

Updates apply prospectively from the stated effective date. The terms accepted when an order is placed govern that order, subject to applicable law. We will provide additional notice or obtain consent where required.
